The following Privacy Policy applies to any information you provide to Unimarket through your registration with, and use of, the following domains: unimarket.com, unimarket.co.nz, unimarket.com.au(Site). By accessing and using the Site, you will be deemed to have agreed to this policy. If you or your organization does not agree to this policy, you must stop accessing and/or using the Site.

The Unimarket Solution is operated and accessed through the Site, which consists of the following:

  • Unimarket Application (website and the Unimarket domains and subdomains);
  • Unimarket Web Services;
  • Unimarket Server Environment.

Amendments

We may amend this Policy from time to time and the most current version will always be available on the Site. If the revision, in our sole discretion, is material we will notify you for review and agreement. By continuing to access or use the Unimarket services after those revisions become effective, you and your organization agree to be bound by the revised Policy unless you notify us otherwise.

Defining Your Information

Information

Information is any information of the following nature (including Financial Information, as defined below) that you provide for the purpose of registering with, and using, the Site:

  • Activity within the Site, including your username and transactions such as purchase orders, and invoices.
  • Metadata including IP address and standard web log data, sign-on and other usage data, and other statistical data.
  • Communication performed through the Site including discussions and correspondence through the site and directly with Unimarket.
  • Information about your organization, including location, contact details and Financial Information (see below).
  • Information about you at your organization. This includes your location and contact details, such as your business email address and your business phone number. This includes some Personally Identifiable Information (PII), such as your real name.

No types of sensitive information will be entered into the Site, such as details of a person’s race, religious beliefs, sexual orientation, health or healthcare information, or personal financial information. Unimarket accepts no responsibility if you choose to enter any type of sensitive information into the Site.

Financial Information

The Site allows you to enter Financial Information as detailed below in this section, into various dedicated fields. If you choose to provide Financial Information it should only be entered in fields marked for these specific types of information:

  • Credit card information.
  • Bank Account information.
  • Tax information.

Financial Information may have additional security controls applied to it in the Site, over and above those applied to other types of Information. Any information entered into fields for Financial Information will not be sent via email to Communities or Suppliers.

What Information do we gather?

Collection of Information

You may provide us information at the time of registration on the Site, or at any other time through subsequent use of the Site.

Audit Trail

To assist customers where necessary, for them to understand user actions, Unimarket associates your Site account with your actions. Your actions are logged in an audit trail that can be reviewed after the event has occurred.

Cookies

Cookies are small text files that are stored by the web browser (such as Microsoft Internet Explorer or Google Chrome) on your computer or mobile device for the purposes of recognizing your computer.

Two types of cookie are used by the Site for two different purposes: (a) session cookies and (b) anonymous analytic cookies.

(a) Session cookies: This type of cookie is issued by the Site to the user’s session each time they login. These are required for the proper function of the Site. It is used by the Site to link the web browser with an active session in the Site.

(b) Anonymous analytics cookies: This type of cookie is not required by the Site to function properly, so they can be disabled by the user through their web browser (but the user may experience some loss of functionality as a result). These are used to provide aggregated information about users.

You can choose to refuse cookies by turning them off in your browser and/or deleting them from your hard drive. Some pages may not function properly if cookies are turned off.

How is your information used?


You acknowledge that, by using the Site, you give consent for Unimarket to disclose information about your organization (including your organization’s location and contact details, information about you or other relevant persons within your organization, and your organization’s transactions and financial information (including payment details) as necessary to facilitate the service that Unimarket provides.

You consent to Unimarket using any Information provided through the Site for all or any of the following purposes:

  • Provide services and customer support as requested by you.
  • Customize, measure, and improve the Site’s content, layout and services.
  • Verify the identity of any user or assist any user in using or accessing the Site or their account. Resolve disputes, collect fees, and provide support to users of the Site.
  • Prevent potentially prohibited or illegal activities, and enforce any User Agreement to which we are a party.

Unimarket will not disclose, provide, sell or rent your Information to any of Unimarket’s affiliated entities, or to any third parties (or for any purpose other than those set out in this policy) without your explicit consent (which may be obtained at the time of collection of that Information, or later). Where Unimarket discloses your Information to its affiliates, agents or subcontractors, the affiliate, agent or subcontractor in question will be obligated to use that Information in accordance with the terms of this policy, and in accordance with all applicable laws.

In addition to the disclosures reasonably necessary for the purposes identified elsewhere above, Unimarket may disclose your Information to the extent that it reasonably believes it is required to do so by any applicable law, in connection with any legal proceedings or prospective legal proceedings, and in order to establish, exercise or defend its legal rights.

Without limiting the above, in an effort to respect your privacy and the security of your Information and our ability to keep the community free from bad actors, we will not otherwise disclose your Information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of such information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity. To the extent possible, any such disclosure will be in accordance with all applicable laws.

Information Privacy

Information Transport & Storage (Data Sovereignty)

The Information that is collected by the Site is stored in the United States. To deliver the Unimarket services, Unimarket engages affiliate organizations that also store your Information in the United States.

To provide the Unimarket services, your Information will be sent to your Suppliers or Communities and the supplier or community may have systems residing outside your jurisdiction. Unimarket is not responsible for data once it has left the Unimarket system.

You consent to your Information being collected, transported, and stored in the manner described above, and used for the purposes specified in this policy. Unimarket will retain your Information until it is no longer needed by Unimarket for the purposes specified in this policy.

Accessing and Correcting Information

Where permitted under the applicable laws, you will have the right to access any Information that has been collected by Unimarket, and verify, correct or update that Information at any reasonable time, and as often as necessary, free of charge. If you wish to do so, or you have any questions or complaints regarding how Unimarket collects, transports, stores, and uses your Information or our compliance with applicable laws, please contact Unimarket using the contact details provided in the Policy. Complaints will be assessed by an appropriate person with the aim of resolving the issue in a timely and efficient manner. We may request further information or assistance from you for the purposes of processing your complaint.

If you are not satisfied with the outcome of our assessment of your complaint, you may have the right to contact applicable privacy bodies.
